BOOKING POLICY AND TERMS


Please carefully review the terms and conditions before booking as they explain corresponding rights and obligations.


The following terms and booking policy applies to any trip and services booked with YUP SHE TRAVELS and forms the basis of your (“you”, “traveler”) contract with YUP SHE TRAVELS.  


BOOKING / PAYMENT TERMS

Paying the deposit to YUP SHE TRAVELS or our third-party partners signifies you have read and accepted the booking policy and terms. The Traveler confirms that a deposit is required to confirm your booking. The Traveler acknowledges the age restriction and confirms they are 18 years of age or older. Upon confirmation of booking, the Traveler agrees to provide personal information YST requires for booking purposes. The Traveler consents to YUP SHE TRAVELS sharing personal information with third-party vendors.

The remaining balance of the tour can be paid in monthly installment payment(s) until the balance is satisfied.  The Traveler will receive electronic invoices sent via email. Invoices should be paid no later than the 15th of every month. Payment of balance should be completed no later than 21 days before the trip start date. Bookings confirmed within 30 days of the trip start day, should pay the trip balance in one lump sum. All payments for tours and services facilitated by YST should be made directly to YUP SHE TRAVELS. YST accepts All major credit cards, Paypal, and Zelle.


PRICE TERMS / ITINERARY / SERVICES

Trips on the YUP SHE TRAVELS website are priced per person at double occupancy. Single occupancy may be available for an additional fee. In addition, room upgrades may be available for an additional fee. Prices reflect the itinerary on the YUP SHE TRAVELS website. While reasonable efforts will be made to maintain an itinerary, unforeseen circumstances may change accommodations and excursions. Traveler acknowledges that that itinerary is tentative and is subject to change at the discretion of YST. 10 days before the trip start date, a detailed itinerary will be sent electronically via email.


CANCELLATIONS BY TRAVELER / REFUND POLICY

All cancelations must be received by YUP SHE TRAVELS in writing and emailed to support@yupshetravels.com. Cancellations received from the date of booking until 60 days prior to the trip start date will receive a 100% refund minus the deposit. Cancellations received 59-31 days prior to the trip start date will receive a 50% refund minus the deposit. All cancelations received within 30 days of the trip start date will incur a cancellation fee of 100% of received payments. Refunds will not be issued for missed activities, services, or included meals. YUP SHE TRAVELS will issue a refund between 7-10 business days.


LATE PAYMENTS

Failure to pay by the date on the invoice will result in a breach of contract and forfeiture of refund. In the event of a breach of contract, YST reserves the right to another party. If an extension is necessary, it must be expressed in writing via email at support@yupshetravels.com.


EXCLUSIONS

The trip package does not include airfare, passports, visas, COVID-19 tests, vaccination certificates, minibar service, gratuities, extra transportation, medical treatments, excursions, or personal care services. The traveler assumes the sole responsibility to obtain required visas, passports, and mandatory country COVID-19 related entry requirements. All costs incurred are the sole responsibility of the Traveler and not YST.


INSURANCE

Mandatory insurance is required for participation in the trip and should be acquired by the Traveler. The acknowledges the cost of the trip does not include insurance and assumes the sole responsibility to purchase insurance to cover liabilities resulting from trip interruptions, trip cancellations, natural disasters, weather, baggage delays, COVID-19. The policy should cover evacuation, repatriation costs, personal injury, and emergency medical expenses. Fourteen days before the trip the Traveler will present proof of insurance. YUP SHE TRAVELS will have no liability for loss, theft, or damage of belongings left unattended on a tour. YUP SHE TRAVELS will not have liability for loss, theft, or damage, incurred on or in hotels, transportation, excursion vehicles, or other modes of transportation.


TRAVELER RESPONSIBILITY / MEDICAL CONDITIONS

Traveler agrees to abide by domestic and international applicable laws and regulations. Travels acknowledges their safety is the sole responsibility of the Traveler. Traveler agrees to refrain from activities that will compromise the safety of themselves or others on the YST trip and will participate in activities responsibly to minimize the risk of injury.  Travelers affected by medical conditions should seek a doctor’s approval before participating in trip activities. Activities that may impact the Traveler’s health should be approached with discretion.


PHOTOGRAPHY / MARKETING

The Traveler grants YUP SHE TRAVELS permission to use my likeness in a photograph in any and all of its publications, including but not limited to all of YUP SHE TRAVELS’ printed and digital mediums. The traveler irrevocably authorizes YUP SHE TRAVELS to edit, alter, copy, exhibit, publish or distribute photos for purposes of marketing and publicizing YUP SHE TRAVELS’ trips, programs, or for any other related, lawful purpose. In addition, the Traveler waves the right to inspect or approve the finished product, including written or electronic copy wherein my likeness appears. Additionally, the Traveler waives any right to royalties or other compensation arising out of or related to, the use of the photographs or videos.


TRAVEL DOCUMENTS

Most countries require a passport to be valid for at least six months beyond the completion of a trip. If Traveler’s passport expires sooner than that, it is the responsibility of the traveler to adhere to the host country's policy and renew the passport. Many countries require at least two blank pages to accommodate entry and exit immigration stamps for each country of travel. Regarding visas, most travel visas that are stamped into passports require an entire blank visa page. A 'blank' visa page must be clean, clear, and not show ink or stains from any other pages in the passport. If the host country requires COVID-19 vaccination certificates to gain entry, it is the responsibility of the Traveler to ensure they are compliant with the laws.


The Traveler assumes all responsibility for any loss or expense incurred because of the Traveler’s failure to obtain required travel documentation. YST resumes no liability for Travelers denied entry to the host country for not adhering to stated policies.


UNFORESEEN CIRCUMSTANCES

YUP SHE TRAVELS trips will not be canceled or inhibited following the terms unless prevented, restricted, or interfered with by causes beyond either party's reasonable control ("Force Majeure"). The term Force Majeure shall include, without limitation, acts of God, plague, epidemic, pandemic, outbreaks of infectious disease, or any other public health crisis, including quarantine or other employee restrictions, fire, explosion, vandalism, storm, or other similar occurrence, orders or acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, or strikes, lock-outs, work stoppages, or other labor disputes, or supplier failures. YUP SHE TRAVELS shall use reasonable efforts under the circumstances to avoid or remove such causes of non-performance and shall proceed to perform with reasonable dispatch whenever such causes are removed or ceased. An act or omission shall be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates.


COVID-19 LIABILITY WAIVER

AGREEMENT TO FOLLOW DIRECTIONS. The Traveler agrees to observe and obey all posted rules and warnings regarding COVID-19, and further agree to follow any oral instructions or directions given by YUP SHE TRAVELS, or the employees, representatives or agents of YUP SHE TRAVELS.

The Traveler recognizes that there are certain inherent risks associated with the above-described activity regarding COVID-19, acknowledge the contagious nature of COVID-19, and assume full responsibility for personal injury and (if applicable) family members, and further release and discharge YUP SHE TRAVELS for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of YUP SHE TRAVELS, whether caused by the fault of Traveler, Traveler’s family, YUP SHE TRAVELS or other third parties.


RELEASE OF LIABILITY

The traveler recognizes that there are certain inherent risks associated with international travel and described activities and agrees to assume full responsibility for personal injury and (if applicable) Traveler’s family members, and further release and discharge YUP SHE TRAVELS fro injury, loss or damage arising out Traveler or Traveler’s family‘s use of or presence upon the facilities of YUP SHE TRAVELS or other third parties. INDEMNIFICATION I agree to indemnify and defend YUP SHE TRAVELS against all claims causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from Traveler’s or Traveler’s family’s use of presence upon facilities of YUP SHE TRAVELS or other third parties.


APPLICABLE LAW

Any legal or equitable claim that may arise from participation in the above shall be resolved under California law.


DISPUTE RESOLUTION

The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.

Any controversies or disputes arising out of or relating to this Agreement will be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitrator's decision will be final, and judgment may be entered upon it by any court having proper jurisdiction.
